TN1, F1, EB3 or E2

 

The first thing to decide is which visa should you apply for? The most common visas a Canadians can apply for are F1 (student visa), EB3 (job sponsored visa) or E2 (investment visa) and TN1 (special classification). If you are already working with a company inside Canada that has a US branch, asking your company to sponsor you to relocate to Canada is by far the easiest option. If you have a graduate degree, you may qualify for the TN1. You can also apply for a job in the US and get sponsored or move to the US and attempt to get a job, then ask your company to sponsor you. This would be the most risky option. Quite a few become students first, to bide some time.

If you are looking at an E2 visa, you are looking to make an investment of a specified amount ($70k USD before you apply, and $150k USD over the course of three years, as well as hiring 3 employees.) There are specific businesses that do not qualify - it must be active income. Instead of starting a company, you can also buy one. The criteria includes spending over $120k USD with a minimum of 3 employees. Again, this company must produce active income.

Moving with or without Spouse/Ex/Kids

 

If you have children, you must have your spouse’s or ex’s consent to move. If your spouse is willing to move with you, he/she may either apply for his/her visa with you, or after you have received yours. It is extremely easy for your spouse to do either of these.

If, however, you are already separated or divorced, and you have children, it is crucial to have his/her consent to move in writing. This consent will be required with your application. If you are already separated or divorced, your ex cannot be part of your application but must submit his/her own.
